About shop accidents

Who is responsible?
Shop owners and management teams have a duty to keep all employees and customers safe while on their premises. This is carried out by completing regular risk assessments to identify and reduce any hazards. In addition, training must be given to all staff to ensure they are able to complete their work safely with an understanding of the importance of following health and safety rules, for example, tidying up work areas.
What to do when you’ve been injured
Should you, unfortunately, suffer an injury in a shop, there are a number of things you can do to help the success of your claim. However, please remember that these tips are solely to be used as guidance and are not to be considered legal advice.
- Do not admit liability, even if you are not sure whether the accident was your fault or not
- Report the accident to a member of staff or manager, ensuring a record of the incident is made in the shop’s accident book. You should be given a copy for your own records. If not, ask for one
- Take the contact details of any witnesses to the accident, including name, telephone number and full address
- Take a photograph of the cause of your accident and, if possible, ask if the store has any CCTV that could have recorded the accident and ask if you can have a copy of it
Making a claim for compensation
All personal injury claims must be made within three years of the accident occurring. If your injury was not apparent right away, the three-year time limit begins from the date you were aware your injury was caused by an accident in a shop, also known as the date of knowledge.
