Train Station Accident Injury Claims
When hundreds of people are rushing through train stations, trying to reach their destination on time, looking up at the boards or down at their phones and often not looking where they’re going, accidents can happen. If you are injured in a train station accident, Aequitas Legal can offer you professional support and legal advice when considering making a claim for financial compensation.
Whilst slips, trips and falls are common occurrences in train stations, the station and railway operators have a duty of care to ensure that the station and trains are fit for use, and that passengers are safe from harm, under the Occupiers Liability Act of 1957. As such, they are liable for many accidents which take place in or near the station, or on trains.
Types of Train Station Accident Injuries
Common accidents that occur in or near train stations are caused by:
- Rain causing slippery wet platforms
- Spillages that are not cleaned up
- Trips over refuse not properly disposed of because of the lack of rubbish bins provided in train stations (which is a counter-terrorism precaution)
- Falls and related injuries when alighting and or boarding a train due to the difference in elevation to the platform.
- Potholes and damaged surfaces
- Slippery surfaces not being gritted or salted appropriately
- Defective doors trapping or closing on passengers causing injury
What to do if you’ve been injured in an accident in or near a train station
- To make a successful claim, your solicitor will need to demonstrate that the rail or station operator failed in their duty of care to make the station safe for purpose. In order to help your solicitor to build the strongest case possible, it is important to:
- Make a note of the date of your accident: you can claim for an accident that occurred up to 3 years later.
Gather proof of attendance: booking confirmation, tickets or receipts. Take photos of the scene and get the contact details of any other passengers who may have witnessed the accident. Also, report the accident to a member of staff at the station.
Gather evidence of accidents or injury: hospital or doctors notes and/or images of the injury from the location of the accident. - Make detailed notes about anything that may have been relevant, for example “Weather warnings for ice had been issued that day and therefore the station manager should have made sure the area outside was properly gritted or salted to avoid passengers slipping.”
Record any financial losses or costs you have sustained as a result of your injury. For example, lost income, benefits or expenses. - Having this information to hand can make the job of the solicitor easier, meaning they will be able to assess your claim quicker, although if you don’t have this, don’t let it put you off. Speak to us so we can advise you accordingly.
