I represented the Claimant who was an agency worker contracted to work on a Construction Site. The Claimant fractured his hand whilst drilling holes in a metal sheet.
The Employment agency, the Occupier of the site and the Principal Contractor for the site were all pursued regarding the claim and they all denied fault.
Upon consideration of various documents, I issued proceedings against the Occupier of the Site.
A Defence was filed denying fault and we exchanged evidence. Soon after this, the Defendant made one of three offers which were all rejected. In the end, the Defendant agreed to accept our proposal for settlement. The claim settled on a 100% basis without the need for a trial hearing.
The agreed settlement figure was £5,000.00 and consisted of compensation for the injuries suffered, loss of earnings, care provided and other expenses.
