I represented a Claimant who was working in the course of his employment when he was given the task of lifting heavy boxes filled with metal from height with no adequate equipment to move such items and limited manual handling training provided.
The Claimant suffered immediate onset of pain in his lower back, numbness in his leg and injury to his lumbar spine. The Claimant did have a history of back pain and pre-existing degenerative changes which was taken into consideration.
Liability was eventually admitted and physiotherapy was negotiated. Following an MRI scan, the Claimant was also seen by a Chiropractor and a further 10 sessions of physiotherapy was agreed and funded by the Defendant.
The Claimant was absent from work for 3 months and his daily tasks were restricted.
The claim settled before proceedings were issued in the sum of £7,500.00 and consisted of compensation for the injuries suffered.
