What is financial mis-selling?

Financial mis-selling is a term used when a borrower has been sold a financial product or service which was not suitable for their needs. However, it can cover a variety of ways where a financial product or service may be deemed unsuitable. For example, at the time of purchase the borrower was not informed of all the relevant terms and condition around the financial product or service, preventing the borrower from making an informed choice to whether this was the financial product right for them.

What is undisclosed commissions?

The role of a broker is to act in the best interest of the borrowers and not themselves. However, lenders would incentivise brokers to put business their way in exchange for receiving commission. Furthermore, the lenders and brokers would fail to disclose this commission to the borrowers. Failure to disclosure the inclusion and/or the value of the commission paid by a lender to a broker, may entitle the borrower to compensation.

Example

In 2007, after falling into financial difficulty, Mr and Mrs Jones, using a broker borrowed monies from the bank, which was secured a which was secured as a second charge to their home. On review of the paperwork some years later, it was clear there were commission payments made payable to the broker were added to the total loan amount.  However, this was never made clear to Mr & Mr Jones at the time the loan was entered into. As a result, the Joneses were awarded the refund of all commissions payment, plus the interest which had paid to date against these charges.
