Claimant suffered scarring following semi-permanent tattoos being wrongly applied

I represented the Claimant who attended beauticians for semi-permanent tattoos to be applied to her eyebrows. She was not offered any consultation prior to the treatment and was not made aware of any risks of the treatment. The tattoos were applied incorrectly, above the natural brow line and in a colour which did not match the Claimant’s skin tone. It transpired when the Claimant complained about the treatment that the Defendant was not fully qualified to be carrying out the procedure.

The Defendant failed to admit liability throughout alleging that the treatment was not carried out negligently and alleging that the Claimant had drunk alcohol in the 24 hours prior to the procedure and this impacted the outcome.  Liability and quantum remained in dispute, therefore the matter proceeded to a trial in which the claimant was successful.

The Claimant suffered physical injuries and medical evidence was used to confirm that the eyebrows had been tattooed incorrectly.

The claim settled for £13,060.24 and consisted of compensation for injuries sustained and for future make-up, camouflage creams, laser treatment and travel expenses.

Claimant suffered a reaction to eyelash extensions

I represented the Claimant who attended beauticians to have her eyelashes tinted. She was not offered any consultation prior to the treatment, she was not made aware of any risks of the treatment or given a patch test prior to the treatment being carried out. She suffered an allergic reaction to the procedure, suffered severe swelling to her eyes, which over the days following the procedure, worsened. The Claimant had to attend the emergency eye hospital.

The Defendant failed to admit liability throughout alleging that the treatment was not carried out negligently. Proceedings were issued and the claim was settled by way of the claimant’s acceptance of a Part 36 offer.

The Claimant suffered physical injuries and medical evidence was used to confirm that she had clearly suffered a reaction as a result of the procedure being carried out negligently.

The claim settled for £12,436.90 and consisted of compensation for injuries and  loss of earnings.

Claimant injured whilst delivering a sofa successfully challenged medical evidence increasing value of claim by £10,000.00

I represented a Claimant who sustained a complicated knee injury whilst delivering a sofa.

The Defendant admitted liability and the Claimant was examined by a Consultant Orthopaedic expert who reviewed the Claimant’s medical records.

The Claimant had a history of knee problems which included undergoing knee surgery. However the Claimant had been symptom free for 4 years before the accident.

Initially the expert suggested the accident caused a minor injury that resolved within a few months and any ongoing symptom were not accident related. However upon further consideration of the Claimant’s medical records and the Claimant’s testimony regarding his pre and post- accident capacity, the expert extended this prognosis to 3 – 5 years.

The claim settled without the need to issue proceedings and includes an award for personal injury, care and assistance, travel and medical expenses.

Volunteer succeeds in claim against company who dismantled marquee when she was underneath it

The Claimant, who suffered with fibromyalgia prior to the accident, had volunteered to Marshall at a steam valley event. As she was dismantling a table under a marquee, some of the staff employed by the event dismantled the marquee itself causing a steel pole to fall and land on the Claimant who suffered an exacerbating of her pre-existing neck and shoulder pain. Her symptoms were exacerbated by a period of one year.

The other party accepted fault but tried to argue that her symptoms were not made worse by such a degree, however, we obtained medical evidence from an Orthopaedic Surgeon who examined the Claimant and reviewed her medical records and who supported the extent of her symptoms. The Claimant accepted an offer of £10,000 which consisted of damages for her injuries, some care provided by her family and some treatment aids such as orthopaedic pillow, tens electrode pads and a magnetic heat health neck support.
