Accidents In The Street

Who is responsible?

In most cases, the local council will be responsible if you are harmed in an accident on a street. This is because they have a legal duty to maintain pavements and roads to an acceptable standard. If the accident is on private land, the owner can be held accountable for any injuries, while construction companies will be responsible if there is an accident caused by any work being carried out on the street.

What to do when you’ve been injured

If you are injured in an accident on the street and haven’t suffered an injury that requires immediate medical attention, there are a number of steps you should take that can help you claim in the long run.

  1. Take down the name, telephone number and address of any witnesses to the accident.
  2. Photograph the area in which your injury occurred and use an item to show the scale of any faults that caused your accident. This includes cracks in the pavement, potholes, and uneven kerbs, e.g. a 50 pence piece resting against the hazard.
  3. Find out who is responsible for the area and report the accident. If your injury was caused by a construction company, they should have an accident book where you can make a record of the incident.
  4. If there is any CCTV in the area, find out who owns the recordings and ask for a copy from them.
