Product Liability

About Manufacturing Claims

Manufacturing claims typically involve a faulty product. A manufacture assumes responsibility under the sales of goods act 1979 that any product they provide is fit for its purpose and use. Consumers are entitled to protection and if a product is faulty which causes any harm or injury to a person using it then that person is entitled to seek compensation.

When someone makes a claim for personal injury damages which have resulted from the presence of a dangerous or defective product, they assert a Product Liability claim against the manufacturer and / or the manufacturers of the component.  If your or a loved one has been seriously injured by a defective product, you may be entitled to seek compensation for your injuries.

We can provide advice on

  • Defective products
  • Car engine emissions
  • Faulty car parts
  • Airbag issues

Who is responsible?

When an individual suffers an accident or injury from the use of a product, a claim for the damages received would fall under the remit of a product liability claim. Manufacturers, distributors, suppliers and retailers are held responsible for any injuries caused as a result of their products or any parts being defective.

Making a claim for compensation

A claim can be made if you have suffered an accident or injury due to the negligence of a manufacturer supplying a faulty product. There is a strict three-year time limit for pursuing compensation, which usually begins from the day of the accident. However, because some symptoms do not always present themselves right away, this limit may begin from the date you knew the injury was caused by an accident or injury was caused by the beautician.

To make a successful claim, you need to prove that the accident / injury was caused by someone else’s negligence, whether it was the manufacturer or the supplier. This is where Aequitas Legal comes in. Our solicitors will help you compile evidence to present to the manufacturer’s insurers and will ensure you understand where you stand at every stage of the process, as well as what your options are going forward.
